In Florida, a juvenile delinquent is any person charged with committing a crime prior to turning 18 years of age.
The decision of whether to treat a delinquent youth in the juvenile or the adult system is made by the state attorney, generally on the basis of the youth’s age, the crime committed, and statutory guidelines.Juveniles arrested and charged with a criminal offense have the right to remain silent and the right to an attorney.
Juveniles arrested for an offense do not have the right to bail, as adults do, and can be detained before trial for up to 21 days. If the charge involves a serious felony, the 21-day detention time limit can be extended an additional 9 days. Juveniles also do not have the right to a jury trial in delinquency proceedings; instead they appear before a circuit court judge assigned to hear delinquency cases. As in adult court, the state has the burden to prove, beyond a reasonable doubt, that the juvenile committed the offense charged.
