Carrying a concealed weapon is not the same offense as carrying a concealed firearm.
Carrying a concealed weapon is a misdemeanor in the State of Florida, whereas carrying a concealed firearm is a felony. The charge of Carrying a Concealed Weaspon pertains to all the weapons that are not firearms. The elements of carrying a concealed weapon are:
An individual knowingly carried the alleged weapon on or about his person, and The alleged weapon was concealed from the ordinary sight of another person.
Simply, it is a crime to conceal, or hide, a weapon from the ordinary sight of another. "On or about" your person means that the weapon cannot be hidden on you or in your clothes, or "about you", such as under your car seat.
Exceptions under Florida's concealed weapons laws are intended for lawful self-defense and will only protect those engaged in lawful self-defense.You may conceal mace, pepper spray, or any self-defense chemical spray. It is also legal to carry these devices inside of pockets and purses. A non-lethal stun gun, Taser, or other non-lethal electric weapon or device that is designed solely for defensive purposes is also allowed.
